Berghain Court Case: How a Berlin Techno Club Changed Tax Law and Redefined Electronic Music as Culture

At some point, techno didn’t stay in dark rooms and underground warehouses, it ended up in a courtroom. And at the center of it all was Berghain, one of the most iconic clubs in the world. For years, clubs in Germany were taxed like any other nightlife business, paying around 19% on ticket sales, the same category as bars or general entertainment venues.

Berghain challenged that classification with a simple argument: people don’t go there just to drink, they go for the music. The case quickly turned into something bigger, raising the question of what a DJ actually is from a legal perspective. Are they just playing tracks, or performing music in real time? The club argued that a DJ set is built live, shaped by selection, mixing, timing and crowd interaction, much closer to a performance than passive playback.

The German court agreed. It ruled that events like those at Berghain could be considered comparable to concerts, recognizing DJ sets as a form of live musical performance. That decision changed the club’s classification and reduced the tax on tickets from 19% to 7%, aligning techno events with other cultural experiences.

On paper, it was a tax case, but its impact went far beyond that. The ruling helped legitimize electronic music within a legal and cultural framework, reinforcing what the scene has known for decades: techno isn’t just nightlife, it’s culture.
